Federal Criminal Telephone Count

As I have explained in another blog, most federal drug charges carry severe penalties.
As experienced federal criminal defense lawyers, we will always explore the possibility of trying to obtain a “telepohone count” instead when a client wishes to plead guilty to a charge.

The advantage of a “telephone count” is that the judge can only give a sentence of four years as the worst possible sentence. A plea to transportation of even a small amount of methamphetamine, cocaine,  or heroin, can carry a minimum term of ten years imprisonment with a maximum of life.

It is not always possible to convince the government to allow an accused to plead to a charge for the unlawful use of a telephone. But as San Diego criminal defense lawyers, we have been successful in many cases.

The Mexico-United States Border War Zone

Today thousands of people continue to carry drugs in their vehicles from Tijuana to the United States Many of these people know what they are doing.  The majority, though, have been duped in some way.  They may be told that their contraband is marijuana, only to find out that it is in fact methamphetamine, cocaine, or heroin, Or they believe they are only carrying a kilogram or two find out that their load is one or two hundred kilograms.  Tijuana /San Ysidro is one war zone.  The majority of the drug cases that I and my Chief Associate Attorney Ryan T. Mardock handle, including the smuggling of people in compartements or with false papers, orginate from the Tijuana/San Ysidro Border.

The war zone has been pushed East.  Now every night in down town Calexico one can watch while individuals form Mexicali lob drugs by sling shot or simply throw them in packages over the fence.  And the drug smugglers and “polleros” (people smugglers) wage a never ending war of cutting holes in the border fence with acetylene torches.

Attorney Receives “miraculous sentence” in federal methamphetamine case

The grandmother of my client, Armando L. had traveled from Mexico to attend the sentencing hearing in front of United States District Court Judge Anhello. With a crucifix in hand in court, she said that she was praying for a miracle for her grandson, who facing a probable sentence of at least five years custody.

The sentence that Armando received today was nothing short of miraculous. While he was initial facing a potential sentence of life imprisonment, through aggressive negotiations with the U.S. Attorney , the government decided to recommend an unusually low sentence of approximately five years.

After my office submitted extensive sentencing documents and reference letters from Armando’s family members , the judge decided that a sentence of only thirty six months was appropriate. The judge focused on the extensive documentation of Armando’s employment history, lack of criminal record, and extensive ties to the community. This is a surprising and unprecedented sentence for multi ounce and numerous deliveries of meth.

Like Armando’s grandmother, I believe that miracles happen from time to time in the court. But in my law office we put in the extensive work and background investigation to maximize the chance for the best sentencing result like that which occurred today.

I know that I will savor the delicious taste of Abuela Rosa’s chili rellenos . And so will Armando, who will probably be free in less than fourteen months instead of ten years after credit for time served and completing the Bureau of Prisons’s drug program.

Russell obtains a twenty four month sentence in a methampehtamine smuggling case.

     On July 11, 2008, my  client Petra T. obtained a sentence of only twenty four months in a multi kilo methamphetamine smuggling case in the United States District Court, Southern District of California (07mj1710.)  The government had initially sought a sentence of ten years.  I am unaware of any case in this court when the court has given so little time for a first methamphetamine smuggling case in light of the mandatory minimum sentence.  At sentencing, the client fell to her knees, and declared, "praise God and God bless you judge."

From the very beginning Cesar C. told me he was innocent and that we were going to trial.  The D.A. put on a parade of drug-addict witnesses who tried to convince the jury that my client, a man with no prior record and a good family, was the triggerman.  The arresting officer told Cesar he “was going to put him away for life.”  Cesar testifed on his own behalf and the jury freed him after one day of deliberation  Cesar is living with his family in San Diego. He still doesn’t understand why the police didn’t believe him over their methamphetamine and PCP using snitches.  Cesar’s mistake was in thinking that the police would seek the truth instead of  wanting to close their old unsolved homicide case.
